VoIP Terms and Conditions

By purchasing from the Hightrees Organisation Limited website, , you agree to be bound by the following Terms & Conditions set out below.

In the following terms and conditions, the words ‘company’, ‘we’, and ‘our’, are used to refer to Hightrees Organisation Limited

Hightrees VoIP services are a telephony service which utilises an internet connection to make and receive telephone calls. Various services are available which include telephone numbers, outbound calling, call plans as well as many other telephony features.

Security

You are responsible for keeping all your passwords secure, strong and confidential at all times. Hightrees Organisation Limited cannot accept any responsibility for unauthorised calls made on your account.

You should always set and use strong passwords, for example minimum 10 characters, mixed numbers, letters and characters and not easy to guess. Beware of using your details on public networks where your details may be stored or intercepted and if you use any kind of PBX or other VoIP hardware, you must ensure that its own passwords and those of any extensions are also secure and strong.

VoIP Calling

Call destinations mentioned on the VoIP Call Packages include mobile and landline destinations and exclude personal and premium rate numbers (unless mentioned otherwise).

Outbound calls and inbound calls to and from the PSTN network respectively, are limited to 2 (two) concurrent calls unless otherwise specified.

In the case of the user call records for outgoing PSTN calls, Hightrees Organisation Limited will allow online retrieval of all call records from the past 90 (ninety) days only.

Price and availability information is subject to change without notice.

Emergency Calls

Emergency calls (999 or 112) are available with the service only once customers have registered a mainland UK address, excluding users located in the Isle of Man or Channel Islands.

Contract period

A minimum contract period is applicable to all subscription services. The minimum contract term is the minimum period for which the customer must remain on and is liable for payment of their service from the time it is activated.

Unless otherwise stated the minimum contract period is 12 (twelve) months.

After the minimum contract period, subscribers may terminate their subscription with one month’s service. Online customers that pay via credit card must terminate a subscription by contacting customer services on +44 (0)1264 848018. All other customers should email a cancellation request to their account manager.

In the event that the contract is subject to distance selling regulation, where service starts within 7 days of purchase, rights of cancellation will end upon commencement of service.

Billing

The subscription fee will be issued monthly. It is your responsibility to ensure your payment details are accurate and up-to-date to ensure we receive payment on the due date. We reserve the right to cancel your subscription if payment is not received every month.

Initial payment is for one month in advance and is non-refundable.

We may suspend and / or disconnect your Services at its discretion. We will normally inform you before we suspend or terminate your access to the Service.

Any credit balance unused for 6 (six) months or more will be deducted from a user’s account. Call credit purchased online is non-refundable upon use of service. Incoming numbers which have not been dialled within the last 6 months may be disabled by us.

A £10 reactivation fee will be charged if a number has not been used (i.e. a call not successfully being answered by the endpoint, whether it is a VoIP device or diverted PSTN destination) within a 6 (six) month period.

We reserve theright to close/block accounts that we suspect to be fraudulent and proof of identification maybe requested to verify users.

Any accounts which have not been used for 6 months or more maybe suspended by us. We will normally inform you before we suspend or terminate your access to the Service. An activation fee may be charged to reinstate the account.

Fair Use Policy

Fair usage policy applies for calling packages with inclusive unlimited monthly minutes.

Service Cancellation

Cancellation of the service will require one months notice from the end of the minimum contract period, stated for the service subscribed to by the user.

Processing, Shipping & Returning orders

Hightrees Organisation Limited aims to ship all items within 7 (seven) days of receiving the order but the order may be delayed if the item is not in stock with our suppliers. Some items may be unavailable. We regret we are not able to supply dates when our suppliers may get an item in stock.

Credit and debit cards are debited before items are shipped by Hightrees Organisation Limited. All prices include sales taxes (where applicable) unless otherwise stated.

In most cases, we will ship products that are in stock the same day if your order is placed MON-FRI, before 2.30pm GMT. If your order is placed after 2.30pm, it will be shipped the next working day. The order should be received the next working day after we ship it. Please note that the order may be sent to you in instalments.

We make every effort to ensure that our site has up-to-date information about product availability. If an item is not in stock at the time you place an order customers may cancel the order at this stage if they wish to do so. We will take appropriate steps to reimburse any payment customers have made in respect of that order.

Shipments to customers delivery address may be subject to import duties and taxes which are levied once a shipment reaches the customers country. Any such additional charges to clear customs must be borne by the customer. Customers should note that customs policies vary widely from country to country so we advise that customers contact their local customs office for further information. Note that international shipments are subject to opening and inspection by customs authorities.

Returns are acceptable for items that are up to 1 (one) year old depending on the condition of the original item at the time of return. Full refunds are only available on items that are returned within 7 (seven) days and are still in their original package and in a brand new condition.

To the fullest extent permitted at law, Hightrees Organisation Limited is providing this site: www.hightrees.org and its contents on an “as is” basis and makes no representations or warranties of any kind with respect to this site or its contents. Hightrees Organisation Limited disclaims all such representations and warranties, including for example warranties of merchantability and fitness for a particular purpose. In addition, Hightrees Organisation Limited does not represent or warrant that the information accessible via this site is accurate, complete or current.

Modification of Terms

Hightrees Organisation Limited reserves the right to modify these terms at any time without prior notice. Any modification of these terms will be deemed to be effective from the date and time of posting on the Hightrees Organisation Limited site. These terms and conditions will apply to your order once you have received your confirmation email. They will supercede any other terms and conditions in whatever form given. Please print and retain a copy of the terms and conditions once you have received your confirmation email.

Limitation of Liability

This liability section applies only to the extent permitted by law.

User agrees to indemnify, defend and hold Hightrees Organisation Limited, its affiliates, directors, officers, employees, agents and licensors harmless from and against any and all claims, actions, expenses, losses, and liabilities (including courts costs and reasonable attorneys’ fees), arising from or relating to this agreement including user’s access to and use of the SIP server to the maximum extent permitted by applicable law, in no event shall Hightrees Organisation Limited or any of its licensors, be liable for any indirect, special, punitive, exemplary, or consequential damages, arising out of the access to or use of or inability to access or use the SIP server, or that result from mistakes, omissions, interruptions, deletions of files, errors, defects, delays in transmission or operation or any failure of performance, even if advised of the possibility of such damages.

The Hightrees Organisation Limited VoIP telephony service is not intended as a substitute of the PSTN telephony service. Registered users must ensure a PSTN telephony line is available at the location from which they use the service.

IMPORTANT INFORMATION

This is a voice over data network service and as such, it is dependent on your connection to the data network and the data network itself. Your service may therefore cease to function if there is a power failure or a failure in the underlying data network. Confirmation by accepting the terms of use, you (hereinafter the ‘user’) are stating that you agree to accept and be bound by all of the terms and conditions of this agreement. Do not proceed if you are unable to agree to the terms and conditions of this agreement. These terms and conditions of service for use of Hightrees Organisation sip server (the ‘agreement’) constitute a legally binding contract between Hightrees Organisation Limited and the entity that agrees to and accepts these terms and conditions. Access to the session initiation protocol server (‘sip server’) is being provided on an ‘as is’ and ‘as available’ basis, and Hightrees Organisation Limited makes no representations or warranties of any kind, whether express or implied, with respect to user’s access of the sip server, including but not limited to warranties of merchantability, non-infringement, title or fitness for a particular purpose. Further, Hightrees Organisation Limited makes no representations or warranties that the sip server or user’s access thereto, will be available at any given time, or will be free from errors, defects, omissions, inaccuracies, or failures or delays in delivery of data. User assumes, and Hightrees Organisation Limited disclaim, total risk, responsibility, and liability for user’s access to and use of the sip server.

Access to the sip service is being provided on a non-exclusive basis. User acknowledges and understands that Hightrees Organisation Limited makes no guarantees regarding the availability or functionality thereof. User may not sublicense its access rights to the sip server to any third party.

You accept e-mail as a valid means of communication of any agreement between you and Hightrees Organisation Limited. You must check that the details of your confirmation email are correct as soon as possible and you should print out and keep a copy for your records. This confirmation e-mail amounts to an acceptance by Hightrees Organisation Limited (or 3rd party supplier that is engaged on your behalf by Hightrees Organisation Limited) of your offer to buy goods from Hightrees Organisation Limited and this acceptance is effective regardless of whether or not you receive the e-mail.

Hightrees Organisation Limited services are free to be withdrawn from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods, any description applied to the goods, the availability of the goods or the order itself.
